Measures of Chongqing Municipality for Further Utilising Foreign Capital

重慶市の外資利用事業(yè)の更なる実施に係る若干措置

為認真貫徹落實《國務院關于進一步做好利用外資工作的意見》（國發(fā)〔2019〕23號）精神，進一步擴大對外開放，深入推進內陸開放高地建設，持續(xù)營造市場化、法治化、國際化的營商環(huán)境，結合我市實際，提出如下措施。

Given the reality of Chongqing, the following measures are introduced in a bid to implement the spirit of the Opinions of the State Council on Further Fulfilling the Work of Using Foreign Capital (GF [2019] No. 23), to open wider to the outside world, to further advance the building of inland hubs of opening-up, and to continuously create a market-oriented, law-based and internationalized business environment.

「國務院による外資利用事業(yè)の更なる実施に関する意見」（國発[2019]23號）の精神を念入りに貫徹?実行し、対外開放をより一層拡大し、內陸開放高地の建設を深く推進し、市場化?法治化?國際化のビジネス環(huán)境を持続的に構築するため、當市の実情に照らし、以下の措置を提出する。?

一、進一步擴大對外開放?

1. Opening Wider to the Outside World

一、対外開放のさらなる拡大

（一）支持外商投資新開放領域的先行先試。落實《外商投資準入特別管理措施（負面清單）》《自由貿易試驗區(qū)外商投資準入特別管理措施（負面清單）》，加快推進數(shù)字經(jīng)濟、金融等領域對外開放，鼓勵外商投資新開放領域，爭取項目率先落地。（責任單位：市發(fā)展改革委、市經(jīng)濟信息委、市商務委、市市場監(jiān)管局、市金融監(jiān)管局、市大數(shù)據(jù)發(fā)展局、人行重慶營管部、重慶銀保監(jiān)局、重慶證監(jiān)局）
? ?? (1) Supporting the pilots on opening more market access to foreign investment. Chongqing will implement the Special Administrative Measures (Negative List) for Foreign Investment Access and the Special Administrative Measures (Negative List) for Foreign Investment Access in Pilot Free Trade Zones to accelerate the opening-up of the digital economy, finance and other fields. Efforts will be made to encourage the entry of foreign investors into the newly opened fields of the economy and have their projects implemented in a swift manner. (Policy implementers: Chongqing Development and Reform Commission, Chongqing Municipal Commission of Economy and Information Technology, Chongqing Commerce Commission, Chongqing Administration for Market Regulation, Chongqing Local Financial Supervision and Administration Bureau, Chongqing Big Data Development Bureau, Chongqing Operations Office of the People’s Bank of China, Chongqing Office of China Banking and Insurance Regulatory Commission, and Chongqing Office of China Securities Regulatory Commission)

（一）新たに外商投資を開放した分野における先行?試行を支持する?！竿馍掏顿Y參入特別管理措置（ネガティブリスト）」「自由貿易試験區(qū)における外商投資參入特別管理措置（ネガティブリスト）」を実行に移し、デジタル経済?金融等の分野における対外開放の推進を加速し、外商投資の新たな分野開放を奨勵し、プロジェクトの率先した実施を目指す。（擔當機関：市発展改革委員會、市経済情報委員會、市商務委員會、市市場監(jiān)督管理局、市金融監(jiān)督管理局、市ビッグデータ発展局、人民銀行重慶営業(yè)管理部、中國銀行保険監(jiān)督管理委員會重慶監(jiān)管局、中國証券監(jiān)督管理委員會重慶証監(jiān)局）

（二）加大自由貿易試驗區(qū)開放力度。支持中國（重慶）自由貿易試驗區(qū)（以下簡稱重慶自貿試驗區(qū)）按照“一項目一議”的方式，爭取在科研和技術服務、電信和跨境數(shù)字貿易、醫(yī)療科技、數(shù)字出版等重點領域實現(xiàn)更大力度的開放。支持重慶自貿試驗區(qū)先行先試的舉措經(jīng)驗率先在開放平臺復制推廣。（責任單位：市商務委、市發(fā)展改革委、市經(jīng)濟信息委等）

?(2) Implementing intensified opening-up measures in China (Chongqing) Pilot Free Trade Zone. According to the principle of case-by-case deliberation for each project, China (Chongqing) Pilot Free Trade Zone (Chongqing FTZ or CFTZ) will receive support for its further opening-up in key sectors such as scientific research, technical services, telecommunication, cross-border digital trade, medical technology and digital publishing. Chongqing will also support the roll-out of best practices and know-how accumulated from pilot projects of Chongqing FTZ in open platforms. (Policy implementers: Chongqing Commerce Commission, Chongqing Development and Reform Commission, and Chongqing Municipal Commission of Economy and Information Technology)

（二）自由貿易試験區(qū)の開放を強化する。中國（重慶）自由貿易試験區(qū)（以下、「重慶自貿試験區(qū)」という）が「一項目一會議」の方式に基づき、科學研究及び技術サービス?通信及びクロスボーダーデジタル貿易?醫(yī)療テクノロジー?デジタル出版等の重點分野においてより強い開放を実現(xiàn)することを支持する。重慶自貿試験區(qū)の先行?試行の措置経験がオープンプラットフォームにおいて率先して複製?普及することを支持する。（擔當機関：市商務委員會、市発展改革委員會、市経済情報委員會等）?

（三）健全外商投資全流程服務體系。加強“行政服務管家”隊伍建設，健全重點外商投資企業(yè)聯(lián)系服務制度，市、區(qū)縣（自治縣，含開發(fā)區(qū)，以下統(tǒng)稱區(qū)縣）、鄉(xiāng)鎮(zhèn)（街道）三級分別確定重點服務對象名單，選派干部擔任“行政服務管家”，當好政策宣傳員、項目推進員、問題協(xié)調員、信息溝通員，實行“行政服務管家”首問負責制，為外商投資提供一站式服務。建立外商投資服務清單制度，涉及外商投資的審批核準備案部門應公開審批辦理內容、流程、條件、時限、聯(lián)系人及聯(lián)系方式，嚴禁擅自增加審核要求、超出辦理時限、違規(guī)干預外商投資自主權。（責任單位：市商務委、市招商投資局、市發(fā)展改革委、市市場監(jiān)管局等，各區(qū)縣政府）

?(3) Establishing a full-fledged, whole-process foreign investment service system. Chongqing will work harder on the building of an "administrative service steward" team and improve the contact service mechanisms for key foreign-invested enterprises. The three levels of administrative divisions, such as cities, districts, and counties (including autonomous counties and development zones, hereinafter referred to as "districts and counties") and towns (including subdistricts), will determine a list of key enterprises they will serve and appoint dedicated administrative service stewards who will act as policy publicists, project promoters, problem coordinators, and communicators. The "administrative service stewards" will be held accountable for giving satisfactory responses and one-stop services for foreign investors. A list system of foreign investment services will be established. The departments responsible for approval and registration of foreign-invested enterprises shall disclose approval information, such as the content, procedures, conditions, time limits, contact persons and contact information. It is strictly forbidden to increase the project review requirements without authorization, exceed the time limit for processing, and illegally interfere in foreign investment autonomy. (Policy implementers: Chongqing Commerce Commission, Chongqing Municipal Investment Promotion Bureau, Chongqing Development and Reform Commission, Chongqing Administration for Market Regulation and district and county governments)

（三）外商投資の全プロセスサービス體系を健全化する。「行政サービス執(zhí)事」チームの建設を強化し、重點外商投資企業(yè)連絡サービス制度を健全化し、市?區(qū)県（自治県に開発區(qū)を含む。以下、區(qū)県と総稱する）?郷鎮(zhèn)（街道）の三級についてそれぞれ重點サービス対象リストを確定し、政策宣伝員?プロジェクト推進員?問題協(xié)調員?情報コミュニケーション員をしっかり務めるために、幹部を選任して「行政サービス執(zhí)事」を擔當させて、「行政サービス執(zhí)事」初問擔當制を実行し、外商投資にワンストップ式サービスを提供する。外商投資サービスリスト制度を構築し、外商投資に関わる審査?認可?備案部門は、審査認可手続の內容?プロセス?條件?期限?連絡先及び連絡方法を公開しなければならず、許可のない審査要求の追加、手続期限の超過、外商投資の自主権に規(guī)定に違反して干渉することを厳禁する。（擔當機関：市商務委員會、市招商投資局、市発展改革委員會、市市場監(jiān)督管理局等、各區(qū)県政府）

（四）支持開展境內外投資促進活動。發(fā)揮中國國際智能產業(yè)博覽會、中國西部國際投資貿易洽談會的平臺效應，舉辦“跨國公司重慶行”主題活動。建立市領導與重要外國商協(xié)會、境外跨國公司及在渝重點外商投資企業(yè)定期溝通機制。鼓勵舉辦以“投資重慶”為主題的境內外投資促進活動，各區(qū)縣政府可按照活動引資實際效果，予以資金支持。支持各區(qū)縣組織團組出國（境）開展招商引資工作，對有招商引資任務的出國（境）經(jīng)貿團組，予以優(yōu)先保障。（責任單位：市商務委、市招商投資局、市經(jīng)濟信息委、市政府外辦，各區(qū)縣政府）

??(4) Fostering domestic and overseas investment promotion campaigns. Chongqing will give full play to the influence of the platforms like the Smart China Expo and the Western China International Fair for Investment and Trade, whose subactivity themed "Multinational Corporations' Tour in Chongqing" will also be held. A regular communication mechanism among municipal leaders, key foreign business associations, overseas multinational companies, and leading foreign-invested enterprises in Chongqing will be in place. All district and county governments will be encouraged to conduct domestic and overseas investment promotion campaigns themed "Investment in Chongqing", funds for which can be provided according to the actual inflow of foreign investment. All districts and counties will also be supported to send delegations to areas outside the Chinese mainland to attract foreign investment. Priority will be given to the outbound economic and trade groups with investment promotion tasks. (Policy implementers: Chongqing Commerce Commission, Chongqing Municipal Investment Promotion Bureau, Chongqing Municipal Commission of Economy and Information Technology, the Foreign Affairs Office of Chongqing Municipal People's Government and district and county governments)

（四）中國本土內外の投資促進活動の実施を支持する。中國國際スマート産業(yè)博覧會（Smart China Expo）、中國西部國際投資貿易商談會のプラットフォーム効果を発揮し、「多國籍企業(yè)重慶行」をテーマとした活動を開催する。市の指導者と重要な外國商協(xié)會、中國本土以外の多國籍企業(yè)及び重慶における重點外商投資企業(yè)との定期的なコミュニケーションメカニズムを構築する?！钢貞cへの投資」をテーマとする中國本土內外の投資促進活動の開催を奨勵し、各區(qū)県政府は活動による資金導入の実際の効果に基づき、資金支援を行うことができる。各區(qū)県が組織した団體が海外（中國本土以外）で企業(yè)誘致?投資導入活動を展開することを支持し、企業(yè)誘致?投資導入任務を有する海外（中國本土以外）経済貿易団體に対して、優(yōu)先的に保障する。（擔當機関：市商務委員會、市招商投資局、市経済情報委員會、市政府外事弁公室、各區(qū)県政府）

（五）提升開放平臺引資質量。發(fā)揮重慶自貿試驗區(qū)、中新（重慶）戰(zhàn)略性互聯(lián)互通示范項目、兩江新區(qū)、重慶高新區(qū)、重慶經(jīng)開區(qū)等開放平臺的產業(yè)和政策優(yōu)勢，積極推動重大外資項目落地，強化平臺招商引資功能。加快國別產業(yè)合作園區(qū)建設，鼓勵創(chuàng)建國際合作生態(tài)產業(yè)園。鼓勵有條件的區(qū)縣政府設立境外招商中心，與境外園區(qū)開展合作，引進優(yōu)質項目。（責任單位：市商務委、市經(jīng)濟信息委、市政府外辦、市中新項目管理局、市招商投資局，兩江新區(qū)管委會、重慶高新區(qū)管委會、重慶經(jīng)開區(qū)管委會，各區(qū)縣政府）?

?(5) Improving the quality of foreign investment through open platforms. The industrial and policy advantages of open platforms, such as Chongqing FTZ, China-Singapore (Chongqing) Demonstration Initiative on Strategic Connectivity, Liangjiang New Area, Chongqing Hi-Tech Industrial Development Zone, and Chongqing Economic and Technological Development Zone, will be utilized to actively promote the launching of major foreign investment projects and enhance the investment promotion function of these platforms. The construction of cooperative industrial parks between China and foreign countries will be accelerated and the establishment of international cooperation eco-industrial parks will be encouraged. District and county governments meeting requirements will be encouraged to set up overseas investment promotion centers, which will cooperate with overseas parks to introduce high-quality projects. (Policy implementers: Chongqing Commerce Commission, Chongqing Municipal Commission of Economy and Information Technology, Foreign Affairs Office of Chongqing Municipal People's Government, China-Singapore (Chongqing) Demonstration Initiative on Strategic Connectivity Administrative Bureau, Chongqing Municipal Investment Promotion Bureau, Chongqing Liangjiang New Area Administrative Committee, Administrative Committee of Chongqing Hi-Tech Industrial Development Zone, Management Committee of Chongqing Economic and Technological Development Zone and district and county governments)

（五）オープンプラットフォームによる資金導入の質を高める。重慶自貿試験區(qū)?中新（重慶）戦略的相互接続モデルプロジェクト?両江新區(qū)?重慶ハイテク區(qū)?重慶経済技術開発區(qū)等のオープンプラットフォームの産業(yè)及び政策的優(yōu)位性を発揮し、重大外資プロジェクトの実施を積極的に推進し、プラットフォームの企業(yè)誘致?投資導入機能を強化する。國別産業(yè)協(xié)力パークの建設を加速し、國際協(xié)力生態(tài)産業(yè)パークの設立を奨勵する。條件の整った區(qū)県政府が中國本土以外に企業(yè)誘致センターを設立し、中國本土以外のパークとの協(xié)力を図り、良質なプロジェクトを導入することを奨勵する。（擔當機関：市商務委員會、市経済情報委員會、市政府外事弁公室、市中新プロジェクト管理局、市招商投資局、両江新區(qū)管理委員會、重慶ハイテク區(qū)管理委員會、重慶経済技術開発區(qū)管理委員會、各區(qū)県政府）

（六）加大重點外資項目支持力度。對符合我市產業(yè)發(fā)展導向的外商投資新設或增資項目，以及境外注冊的跨國公司在我市設立的區(qū)域總部或功能性總部機構，市政府有關部門、區(qū)縣政府可按照對本區(qū)域經(jīng)濟社會綜合貢獻度給予獎勵。鼓勵外商投資設立各類研發(fā)機構，對符合條件的研發(fā)機構，參照《重慶市人民政府辦公廳關于印發(fā)重慶市引進科技創(chuàng)新資源行動計劃（2019—2022年）的通知》（渝府辦發(fā)〔2019〕126號）給予支持。積極支持符合條件的外商投資企業(yè)申請中央服務業(yè)專項資金。（責任單位：市經(jīng)濟信息委、市科技局、市財政局、市商務委，各區(qū)縣政府）

(6) Increasing support for key foreign investment projects. For the newly established or additionally-funded foreign investment projects that follow the industrial development direction of Chongqing, as well as regional headquarters or functional headquarters institutions established in Chongqing by multinational companies registered overseas, relevant departments of the Chongqing Municipal People's Government and district and county governments may grant rewards according to their comprehensive economic and social contribution to this region. Chongqing will encourage foreign-invested enterprises to set up various R&D institutions and support the eligible ones based on the Notice of the General Office of the Chongqing Municipal People's Government on Issuing Chongqing’s Action Plan for the Introduction of Technology Innovation Resources (2019-2022) (YFBF [2019] No. 126). Active efforts will be made to support qualified foreign-invested enterprises to apply to the central government for special funds for the service industry. (Policy implementers: Chongqing Municipal Commission of Economy and Information Technology, Chongqing Science and Technology Bureau, Chongqing Finance Bureau, Chongqing Commerce Commission and district and county governments)

（六）重點外資プロジェクトへの支援を強化する。當市の産業(yè)発展の方向性に合致する外商投資の新設或いは増資プロジェクト及び中國本土以外で登録した多國籍企業(yè)が同市に設立した地域本部或いは機能的本部機構に対して、市政府の関連部門、區(qū)県政府は、當該地域の経済社會に対する総合的な貢獻度に基づいて奨勵を與えることができる。外商投資による各種研究開発機構の設立を奨勵し、條件に合致する研究開発機構に対して、「重慶市人民政府弁公庁による重慶市科學技術革新資源導入行動計畫（2019～2022年）の印刷?公布に関する通知」（渝府弁発[2019]126號）を參照して支援を提供する。條件に合致する外商投資企業(yè)が中央サービス業(yè)特別資金を申請することを積極的に支援する。（擔當機関：市経済情報委員會、市科學技術局、市財政局、市商務委員會、各區(qū)県政府）

（七）探索建立市場化招商引資獎勵機制。鼓勵專業(yè)化的社會組織、招商機構引進符合我市產業(yè)發(fā)展導向的外資項目，各區(qū)縣政府可按照引進項目對本區(qū)域的經(jīng)濟社會綜合貢獻度給予獎勵。支持各區(qū)縣政府將招商成果、服務成效等納入考核激勵，對招商部門、團隊內非公務員編制人員采取靈活的激勵措施，提升招商活動市場化運作水平。（責任單位：市財政局、市人力社保局、市商務委、市招商投資局，各區(qū)縣政府）

?(7) Exploring the establishment of a market-based incentive mechanism for investment promotion. Measures will be taken to encourage professional social organizations and investment promotion institutions to introduce foreign investment projects that conform to Chongqing's industrial development direction. These projects will be rewarded by district and county governments according to their comprehensive economic and social contribution to this region. Support will be given to district and county governments to include investment promotion results and service effectiveness in the performance and incentive mechanism. More flexible incentive measures will be adopted to motivate investment development departments and non-civil-servant staff in investment development teams, thus realizing more market-based operations in investment promotion. (Policy implementers: Chongqing Finance Bureau, Chongqing Municipal Human Resources and Social Security Bureau, Chongqing Commerce Commission, Chongqing Municipal Investment Promotion Bureau and district and county governments)

（七）市場化した企業(yè)誘致?投資導入奨勵メカニズムを模索し、確立する。専門的な社會組織?企業(yè)誘致機構が當市の産業(yè)発展の方向性に合致する外資プロジェクトを導入することを奨勵し、各區(qū)県政府は當該地域の経済社會に対する導入プロジェクトの総合貢獻度に応じて奨勵を與えることができる。各區(qū)県政府が誘致成果?サービス成果等を審査?奨勵に組み入れ、企業(yè)誘致部門?チーム內の非公務員編成人員に対して柔軟な奨勵措置を講じ、企業(yè)誘致活動の市場化運営レベルを向上することを支持する。（擔當機関：市財政局、市人的資源と社會保障局、市商務委員會、市招商投資局、各區(qū)県政府）

（八）優(yōu)化外資項目規(guī)劃用地審批。在“多規(guī)合一”的基礎上，持續(xù)優(yōu)化審批管理機制，全面探索推行建設項目選址意見書、建設項目用地預審意見等“多審合一”；建設用地規(guī)劃許可證、建設用地批準書等“多證合一”；規(guī)劃竣工核實測量、人防核實測量、消防核實測量等“多測合一”；規(guī)劃、消防、人防、檔案管理等“多驗合一”。（責任單位：市規(guī)劃自然資源局、市住房城鄉(xiāng)建委）

?(8) Optimizing the approval of planning land for foreign-invested projects. Based on the "integration of regulations", Chongqing will continue to optimize the approval management mechanism, and make greats efforts to promote the "integration of approvals", such as opinions on site selection and pre-approval of land use of construction projects; the "integration of certificates" such as construction land planning permits and approvals; the "integration of measurements" such as verification measurements of completion, civil air defence compliance, and fire prevention and control; and the "integration of tests" such as planning, fire prevention and control, civil air defence, and archives management. (Policy implementers: Chongqing Municipal Bureau of Planning and Natural Resources, Chongqing Municipal Commission of Housing and Urban-Rural Development)

（八）外資プロジェクト計畫用地に対する審査プロセスの最適化?！付嘁?guī)合一」の基礎に基づいて、審査認可管理メカニズムを持続的に最適化し、建設プロジェクト立地意見書や建設プロジェクト用地事前審査意見などの「多審合一」、建設用地計畫許可証や建設用地批準書などの「多証合一」、計畫竣工確認?測量や人防確認?測量及び消防確認?測量などの「多測合一」、計畫?消防?人防?ファイル管理などの「多験合一」を模索し、推進する。（擔當機関：市計畫自然資源局、市住宅都市農村建設委員會）

（九）優(yōu)化重點外資項目工程建設審批。對建筑面積3000平方米以下的外資項目不再開展施工圖審査，實行告知承諾制和建設、勘察設計單位人員終身負責制，由建設單位和勘察設計單位承諾其勘察設計文件符合公共利益、公眾安全和工程建設強制性標準要求，建設行政主管部門通過設計質量檢査等方式加強事中事后監(jiān)管。住房建設、交通運輸、水利等部門按照各自職責分工，加強對工程勘察設計活動的指導監(jiān)督管理，建立健全勘察設計行業(yè)信用評價機制。（責任單位：市住房城鄉(xiāng)建委、市交通局、市水利局等）

(9) Optimizing the construction approval of key foreign investment projects. For foreign-funded projects with a construction area of less than 3,000 square meters, the review of construction drawings will no longer be carried out. Notification-commitment and a lifelong responsibility system towards staff in construction, survey and design units shall be implemented. And the construction, survey and design units shall undertake that their survey and design documents conform to the public interest, public safety and the mandatory standard requirements for project construction. Competent administrative departments of construction shall strengthen supervision during and after construction through design quality inspection and other means. Departments in housing construction, transportation, and water resources shall, according to their respective functions and responsibilities, strengthen the guidance, supervision and management of engineering survey and design activities, and establish and improve the credit evaluation mechanism of survey and design industry. (Policy implementers: Chongqing Municipal Commission of Housing and Urban-Rural Development, Chongqing Municipal Transportation Bureau, and Chongqing Water Resources Bureau)

（九）重點外資プロジェクトのプロジェクト建設審査認可を最適化する。建築面積が3000平方メートル以下の外資プロジェクトについては施工図面審査を行わず、告知承諾制及び建設?勘査設計単位擔當者終身責任制を実行し、建設単位及び勘査設計単位はその勘査設計文書が公共利益、公衆(zhòng)安全及び工事建設の強制的基準の要求に合致することを承諾し、建設行政主管部門は設計品質検査等の手段を通じて過程中及び事後の監(jiān)督管理を強化する。住宅建設?交通運輸?水利等の部門は各自の職責に基づいて分業(yè)し、工事の勘査設計活動に対する指導監(jiān)督管理を強化し、勘査設計業(yè)界の信用評価メカニズムを構築?健全化する。（擔當機関：市住宅都市農村建設委員會、市交通局、市水利局など）

（十一）提高外籍人士工作便利度。全面落實提高外國人來華工作便利度各項政策，對有創(chuàng)新創(chuàng)業(yè)意愿的外國留學生，可憑中國高校畢業(yè)證書申請2年私人事務類居留許可，已連續(xù)2次申請辦理工作類居留許可的外國人，可在第三次申請時按規(guī)定簽發(fā)5年有效期的工作類居留許可。推廣外國人工作、居留“單一窗口”，實現(xiàn)“一表申請”“一窗受理”“一網(wǎng)通辦”“一站服務”。綜合考慮各區(qū)縣政府機構設置、人員配備、業(yè)務需求量等因素，推動外國人來渝工作許可審批權下放。簡化重慶自貿試驗區(qū)內外籍人士合法收入購付匯手續(xù)及證明材料，支持在渝工作的外籍人士用境內合法收入投資境內合格金融投資產品。（責任單位：市政府外辦、市科技局、人行重慶營管部、市公安局）

?(11) Simplifying administrative procedures for foreigners in job applications. Chongqing will implement policies to make it easier for foreigners to work in China. Foreign students with the intention of innovation and entrepreneurship can apply for a 2-year residence permit for private affairs with their graduation certificates from Chinese universities. Foreigners who have applied for work-based residence permits twice in a row can obtain a permit valid for 5 years upon the third application. Chongqing will promote the "single window" for foreigners' work and residence to realize the "one form for applications", "one window for enquiries", "one integrated online government service platform" and "one-stop service". Decentralization of the approval of work permit for foreigners in Chongqing will also be promoted according to considerations such as the structure, staffing and business demand of government agencies in districts and counties. （十二）支持跨境資本投資便利。簡化銀行端外商直接投資業(yè)務操作，外商投資企業(yè)可憑市場監(jiān)管注冊信息在銀行辦理境內直接投資外匯登記。在全市范圍內實行更高水平跨境人民幣貿易投資便利化措施，銀行可在“展業(yè)三原則”基礎上，憑企業(yè)首付款指令直接辦理經(jīng)常項下和直接投資項下人民幣跨境結算業(yè)務。在全市范圍內開展資本項目外匯收入支付便利化業(yè)務，符合條件的企業(yè)在將資本金、外債、境外上市資金等資本項目外匯收入用于境內支付時，無需事前逐筆提供真實性證明材料。（責任單位：人行重慶營管部）

?(12) Facilitating cross-border capital investment. Chongqing will simplify foreign direct investment banking and allow foreign-invested enterprises to make foreign exchange registration for domestic direct investment at banks with their market supervision registration information. Better facilitation measures for cross-border RMB trade and investment will be implemented throughout the city. Under the "Three Principles of Business Development" (i.e. know your customers, know your businesses, conduct due diligence), banks can handle RMB cross-border settlement for current accounts and direct investment with the down payment instructions of enterprises. Foreign exchange income payment facilitation for capital projects will be carried out throughout Chongqing. Qualified enterprises are not required to provide authenticity certification materials one by one beforehand when using foreign capital income from capital projects such as capital, foreign debt, and overseas listed funds for domestic payments. District and county governments will establish and improve the "one-stop" working mechanism for handling of complaints from foreign-invested enterprises, disclose related offices and their contact information to the public, and improve the closed-loop handling process of complaint reception, coordination and transfer, handling, and timely feedback, so as to improve the handling efficiency. Chongqing will improve the integrity of government, and fully implement the preferential policies that have been publicly implemented, government commitments that meet relevant laws and regulations, and agreements that have been concluded. No unit will restrict the cross-regional operation, relocation and cancellation of foreign-invested enterprises according to law. If a foreign-invested enterprise receives no reply within 30 days after submission of a request for change of domicile, its request for change shall be deemed to have been approved. For the administrative normative documents concerning the adjustment of investment, production and operation activities of enterprises, Chongqing will reasonably determine the time of issuing and implementing such documents, so as to reserve time for enterprises to adjust. （十九）發(fā)揮知識產權司法保護重要作用。充分發(fā)揮財產保全、證據(jù)保全、行為保全的制度效能，推進知識產權案件繁簡分流，提高知識產權司法救濟的及時性和便利性。優(yōu)化涉及外商投資企業(yè)知識產權案件中對證據(jù)形式要件的要求，依法適用證據(jù)妨礙和舉證責任轉移，合理減輕權利人的舉證負擔。加大知識產權侵權違法行為懲治力度，對具有重復侵權、惡意侵權以及其他嚴重侵權情節(jié)的，依法加大賠償力度，提高賠償數(shù)額。深化知識產權民事、行政、刑事“三合一”審判機制改革，加大知識產權犯罪懲治力度。適時出臺有關法律適用指引，發(fā)布司法保護知識產權典型案例，提高企業(yè)運用司法手段保護知識產權的意識和能力。健全公安知識產權執(zhí)法機制，強化打擊假冒偽劣商品犯罪偵査總隊（市知識產權刑事保護中心）職能職責，加大侵犯知識產權案件偵辦力度。（責任單位：市高法院、市公安局）

?(19) Giving full play to the important role of judicial protection of intellectual property rights (IPR). Chongqing will give full play to the efficacy of preservation of properties, evidence and behaviors, further separate the handling of simple and complex IPR cases, and improve the timeliness and convenience of judicial remedy for IPR. Chongqing will optimize the requirements for the formalities of evidence in IPR cases involving foreign-invested enterprises, apply the obstruction of evidence and transfer of burden of proof according to law, and therefore reasonably reduce the burden of proof on the right holder. Chongqing will impose tougher punishment on IPR infringement, and raise compensation according to law for repeated and malicious infringements and other serious cases. Chongqing will deepen the reform of the "three-in-one" trial mechanism of civil, administrative and criminal cases involving IPR, toughen up punishment for IPR infringement, and issue relevant guidelines on the application of laws and typical cases of judicial protection of IPR in time, so as to enhance the awareness and capability of enterprises in protecting IPR by judicial means. Chongqing will improve the law enforcement mechanism of public security regarding IPR, strengthen the duties and responsibilities of the criminal investigation brigade for cracking down on the production and sales counterfeit and substandard goods (Chongqing Municipal Intellectual Property Criminal Protection Center), and intensify the efforts in investigation and handling of cases of IPR infringement. （十九）知的財産権に対する司法保護の重要な役割を果たす。財産保全、証拠保全、行為保全の制度的効力を十分に発揮し、知的財産権案件における複雑案件と簡単案件の分流を推進し、知的財産権司法救済の適時性と利便性を高める。外商投資企業(yè)に関わる知的財産権事件における証拠形式要件に対する要求を最適化し、法に従って証拠妨害と挙証責任の移転を適用し、権利者の挙証負擔を合理的に軽減する。知的財産権侵害の違法行為に対する懲罰を強化し、重複侵害、悪意的侵害及びその他の重大な侵害事由がある場合、法に従って賠償を強化し、賠償金額を引き上げる。知的財産権の民事、行政、刑事の「三合一」裁判メカニズムの改革を深化させ、知的財産権犯罪に対する懲罰を強化する。適時に法律適用に関するガイドラインを公布し、司法的手段による知的財産権保護の典型事例を発表し、企業(yè)が司法的手段を活用して知的財産権を保護する意識と能力を高める。公安の知的財産権法執(zhí)行メカニズムを健全化し、模倣品?粗悪品犯罪捜査総隊（市知的財産権刑事保護センター）の職能?職責を強化し、知的財産権侵害事件の捜査?処理を強化する。（擔當機関：市高級法院、市公安局）

（二十）完善知識產權保護工作機制。充分發(fā)揮各區(qū)縣政府知識產權糾紛人民調解委員會、調解工作室和專業(yè)調解員的作用，構建完善知識產權糾紛多元化解決機制。健全知識產權守信聯(lián)合激勵和失信聯(lián)合懲戒機制，糾正商標惡意搶注和專利非正常申請行為。監(jiān)督電子商務經(jīng)營者履行知識產權等方面的義務，落實知識產權保護“通知—刪除”義務。支持外商投資企業(yè)通過馳名商標途徑擴大保護，加大地理標志跨國保護力度。深入開展知識產權保護國際交流合作。（責任單位：市市場監(jiān)管局、市知識產權局、市政府外辦、重慶海關等）

(20)Improving the working mechanism for IPR protection. Chongqing will give full play to the roles of district and county governments in IPR disputes as the people's mediation committee, mediation studios and professional mediators, and establish and improve a diversified resolution mechanism for IPR disputes. Chongqing will improve the mechanism of encouraging those with good credit records and punishing the opposites regarding IPR, correct malicious trademark registrations and abnormal patent applications, and supervise e-commerce operators to fulfill their obligations regarding IPR, and the "notification-deletion" obligation for IPR protection. （二十一）支持參與標準制定。支持外商投資企業(yè)在標準立項、起草、技術審査及標準實施信息反饋、評估等過程中提出意見和建議，并按照規(guī)定承擔標準起草、技術審査的相關工作及標準的外文翻譯工作。鼓勵企業(yè)制定高于推薦性標準相關技術要求和具有國際先進水平的企業(yè)標準，引導企業(yè)將科技創(chuàng)新成果轉化為企業(yè)標準。及時為我市外商投資企業(yè)參與國家、行業(yè)標準制定提供信息支持。優(yōu)化地方標準制修訂流程，加大地方標準征求意見力度，完善地方標準信息系統(tǒng)。引導吸納企業(yè)參加我市專業(yè)標準化技術委員會，積極推薦企業(yè)參加全國專業(yè)標準化技術委員會工作。（責任單位：市市場監(jiān)管局、市經(jīng)濟信息委、市藥監(jiān)局等）?

(21)Supporting participation in formulation of standards. Chongqing will support foreign-invested enterprises to put forward opinions during the process of standard proposal, standard drafting, technical reviews, and standard implementation information feedback and evaluation, and to undertake relevant work in standard drafting and technical reviews as well as foreign language translation of standards in accordance with regulations. Chongqing will encourage enterprises to formulate international advanced enterprise standards beyond the technical requirements of recommended standards, and guide enterprises to transform scientific and technological innovation achievements into enterprise standards. Chongqing will provide relevant information in a timely manner to enable foreign-invested enterprises in Chongqing to participate in the formulation of national and industrial standards, optimize the process of preparing and revising local standards, and solicit more opinions on local standards to improve the information system for local standards. （二十二）保障依法平等參與政府采購。各單位在政府采購信息發(fā)布、供應商條件確定、評標標準等方面，不得對外商投資企業(yè)實行歧視待遇；不得限定供應商的所有制形式、組織形式、股權結構、投資者國別、產品或服務品牌；不得要求供應商或投標人在當?shù)卦O立分支機構；不得以特定行政區(qū)域或行業(yè)的業(yè)績、獎項作為加分條件排斥或限制潛在投標人。招標公告應根據(jù)招標產品或服務的性質，為投標人預留合理的投標時間。外商投資企業(yè)發(fā)現(xiàn)政府采購中存在違反法律、行政法規(guī)與歧視性采購條件或行為的，可以依法向采購人、采購代理機構提出詢問、質疑，向政府采購監(jiān)督管理部門投訴，采購人、采購代理機構、政府采購監(jiān)督管理部門應當在規(guī)定時限內作出答復或處理決定。（責任單位：市財政局、市發(fā)展改革委、市公共資源交易監(jiān)管局）

(22)Guaranteeing equal participation in government procurement according to law. Relevant units shall not discriminate against foreign-invested enterprises when it comes to government procurement information release, supplier qualification determination, and bid evaluation standards, put restrictions on the ownership, organizational form, and equity structure of suppliers, nationalities of investors as well as product or service brands, require suppliers or bidders to set up local branches, or take performance or awards in specific administrative regions or industries as extra points to exclude or restrict potential bidders. The bidding announcement will consider reasonable bidding time to be reserved for bidders according to the nature of the bidding products or services. If a foreign-invested enterprise finds violations of laws and administrative regulations or discriminatory procurement conditions or behaviors in government procurement, it may inquire and question the purchaser and procurement agency according to law and file a complaint with the government procurement supervision and management department. The purchaser, procurement agency and the government procurement supervision and management department will make a reply or decision within the prescribed time limit.
